Terms and Conditions

Projects created at Stencil LLC (“Stencil”) or projects created by using Craft Kits provided by Stencil, may require the use of various tools (including but not limited to: power tools, hand tools, hardware, paints, wood stains, adhesives, etc.) in Activities related to the creation of DIY craft project(s). Patrons (both paid and un-paid) understand that using these types of tools can be dangerous and can create certain risks, including, but not limited to personal injury, illness, death, or property damage. Patrons who choose to use these types of tools do so at their own risk and do hereby release and forever discharge and hold harmless Stencil and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise from their Activities with Stencil.

Furthermore, Patron agrees to follow the safety rules implemented by Stencil staff. Patron understands that if they violate any of the safety rules, they will be prohibited from using tools at Stencil.

Release and Waiver: Patrons (both paid and un-paid) of Stencil do hereby release and forever discharge and hold harmless Stencil and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from Patron’s Activities with Stencil. Patron understands that this Release discharges Stencil from any liability or claim that the Patron may have against Stencil with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Patron’s Activities with Stencil. Patron also understands that Stencil does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, disability or worker’s compensation insurance in the event of injury or illness.

Refund & Cancellation Policy: All payments and/or deposits made to Stencil are non-refundable. Details of Stencil’s refund and cancellation policy can be found here.

Age Policy: Patrons under the age of 16 are not allowed to use brad nail guns. Patrons under the age of 13 are not allowed to use glue guns.

Medical Treatment: Patron does hereby release and forever discharge Stencil from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Patron’s Activities with Stencil.

Assumption of the Risk: The Patron understands that the Activities include work that may be hazardous to the Patron. Patron hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Stencil from all liability for injury, illness, death, or property damage resulting from the Activities.

Photographic Release: Patron does hereby grant and convey unto Stencil all right, title and interest in any and all photographic images and video or audio recordings made by Stencil during the Patron’s Activities with Stencil, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

Custom Design Release: Patron may request custom designs from Stencil, which Stencil may provide to Patron. Patron does hereby grant and convey unto Stencil all right, title and interest in any and all custom designs made by Stencil, including, but not limited to, any royalties, proceeds, or other benefits derived from such designs.

Artwork: If Patron submits artwork in either digital or physical form to Stencil for use in a craft project, Patron acknowledges either: they own the copyright to the artwork submitted for use or they acquired the appropriate license to use the artwork in their project.

Local Delivery: If customer chooses local delivery for their order, someone must be home to accept delivery of the order. If no one is home, the order will be left at the door/gate, etc, however Stencil LLC is not responsible for any items which are stolen or damaged as a result of being left outside.

Newsletter Subscription: By supplying Stencil with Patron’s email address, Patron agrees to be added to Stencil’s email newsletter subscription. Patron may unsubscribe from the email newsletter at any time.

CraftStar Program: Stencil reserves the right to cancel or change this program at any time.

Drug and Alcohol Policy:  A Patron may not be under the influence of alcohol, illegal drugs, or intoxicants while using the drill press or brad nailing gun.

Gift Cards (also referred to as Gift Vouchers or Gift Certificates): Gift cards are non-refundable. Gift cards cannot be used to purchase other gift cards. Gift cards are not redeemable for cash.

Patron expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of both the State of Arizona and the State of Illinois, and that this Release shall be governed by and interpreted in accordance with both the laws of the State of Arizona and the State of Illinois. Patron agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. By accepting the terms and conditions, the Patron has read, understood, and executed this Release.
