Terms and Conditions
Projects created at Stencil LLC (“Stencil”) may require the use of various tools (including but not limited to: power tools, hand tools, hardware, paints, wood stains, adhesives, etc.) in Activities related to the creation of DIY craft project(s). Patrons (both paid and un-paid) understand that using these types of tools can be dangerous and can create certain risks, including, but not limited to personal injury, illness, death, or property damage. Patrons who choose to use these types of tools do so at their own risk and do hereby release and forever discharge and hold harmless Stencil and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise from their Activities with Stencil.
Furthermore, Patron agrees to follow the safety rules implemented by Stencil staff. Patron understands that if they violate any of the safety rules, they will be prohibited from using tools at Stencil.
Release and Waiver: Patrons (both paid and un-paid) of Stencil do hereby release and forever discharge and hold harmless Stencil and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from Patron’s Activities with Stencil. Patron understands that this Release discharges Stencil from any liability or claim that the Patron may have against Stencil with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Patron’s Activities with Stencil. Patron also understands that Stencil does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, disability or worker’s compensation insurance in the event of injury or illness.
Age Policy: It is the policy of Stencil that Patrons under the age of 18 not be allowed to use corded power tools. Patrons 18 years of age and older are considered to be adults.
Medical Treatment: Patron does hereby release and forever discharge Stencil from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Patron’s Activities with Stencil.
Assumption of the Risk: The Patron understands that the Activities include work that may be hazardous to the Patron. Patron hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Stencil from all liability for injury, illness, death, or property damage resulting from the Activities.
Photographic Release: Patron does hereby grant and convey unto Stencil all right, title and interest in any and all photographic images and video or audio recordings made by Stencil during the Patron’s Activities with Stencil, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Custom Design Release: Patron may request custom designs from Stencil, which Stencil may provide to Patron. Patron does hereby grant and convey unto Stencil all right, title and interest in any and all custom designs made by Stencil, including, but not limited to, any royalties, proceeds, or other benefits derived from such designs.
Refund/Cancellation Policy: Any payments and/or deposits made to Stencil for reservations/classes/workshops/events/parties and custom/personalized projects are non-refundable. In most cases, payments and/or deposits made may be applied towards a future visit if cancelled at least 48 hours prior to the start time of their reservation/class/workshop/event/party, if this is the case it will be noted in the “Cancellation policy” section during checkout. If a custom or personalized stencil was created for Patron’s project, and Patron would like to change their project choice, a $10 fee will be charged to create a new stencil. Projects choices cannot be changed less than 48 hours prior to Patron’s reservation/class/workshop/event/party. Gift cards are non-refundable. Deposits for private parties are non-refundable. If Patron needs to cancel a private party and does so at least 2 weeks prior to the reserved party date, the non-refundable deposit can be applied to a future party date.
Gift Cards (also referred to as Gift Vouchers or Gift Certificates): Gift cards are non-refundable. Gift cards cannot be used to purchase other gift cards. Gift cards are not redeemable for cash.
Newsletter Subscription: By giving Stencil Patron’s email address to make a reservation for a seat/class/workshop/special event/private party, Patron agrees to be added to Stencil’s email newsletter subscription. Patron may unsubscribe from the email newsletter at any time.
Drug and Alcohol Policy: A Patron may not be under the influence of alcohol, illegal drugs, or intoxicants while using corded power tools.
Patron expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Arizona, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Arizona. Patron agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. By accepting the terms and conditions, the Patron has read, understood, and executed this Release.
